Terms of Service

1. Who we are

GrowDozer is operated by TPS Worldwide LLC ("GrowDozer", "we", "us"). These terms are a binding agreement between TPS Worldwide LLC and you, the business creating the account ("you", "your"). By creating an account, clicking to agree, or using the service, you accept these terms.

2. The service

GrowDozer is a marketing and operations platform for small businesses: a hosted website, CRM, lead capture, sales pipelines, calendars and booking, invoicing, email and text messaging, review requests, automations, and AI content tools. Features vary by plan and some depend on third-party carrier or provider approval (for example text messaging requires carrier 10DLC registration).

3. Accounts

You must be at least 18 and have authority to bind the business you sign up for. Keep your login credentials secret; you are responsible for activity under your account. Give us accurate business information, especially for carrier registrations, which legally must match your IRS records.

4. Billing and trials

Paid plans bill a one-time White-Glove Launch fee and a recurring monthly subscription through Stripe. Web signups start with a 14-day full-feature trial: $0 today, a card required, and the launch fee plus the first month bill together when the trial converts on day 14. Cancel before day 14 and you pay nothing. Subscriptions renew monthly until you cancel; you can manage or cancel billing any time from Connections and Settings in your account. Metered usage (such as text messages, phone minutes, and premium AI media) is prepaid through credits at the price shown before each use and is never billed as surprise overage.

Pricing may change over time. Existing customers keep their price for a grandfather window after any increase; new pricing applies to new signups first. We will notify you before a price change affects you.

5. Refunds

Monthly subscription fees are non-refundable once a billing period has started, except where the law requires otherwise. The launch fee is non-refundable once onboarding work has begun. Unused prepaid credits are refundable on request when you close your account. If something went wrong on our side, contact support and we will make it right.

6. Your content and data

Your content and data remain yours. You grant us the license needed to host, process, transmit, and display them to operate the service (including processing through the AI and messaging providers described in our Privacy Policy). You can export your data as JSON from your settings at any time. Account deletion removes your data after a 7-day grace window, except records we must keep for legal or compliance reasons (such as messaging consent records).

7. Acceptable use and messaging compliance

No spam, no unlawful content, no harassment, no malware, and no use that puts the platform's deliverability or other customers at risk. You are solely responsible for your contact lists and for having the legally required consent to message the people on them, including prior express written consent for marketing text messages (TCPA) and compliant commercial email (CAN-SPAM). Honor opt-outs immediately; the platform enforces STOP and unsubscribe automatically and you may not circumvent that. We may suspend or restrict messaging, or the account, to protect deliverability, comply with carrier requirements, or respond to abuse.

8. Reviews

The review tool asks your customers for feedback and always offers every customer your public review link, whatever rating they choose. You may not use the platform to post fake reviews, to offer incentives conditioned on positive reviews, or to suppress lawful reviews.

9. AI features

AI-generated content (posts, emails, website copy, images, video, voice) can be wrong, incomplete, or unsuitable. Review everything before it publishes or sends; you are responsible for what you approve and publish. AI output is not legal, financial, or professional advice. As between you and us, you own the AI-generated content you approve, to the extent permitted by law and the underlying providers' terms.

10. Hosted sites and copyright

Websites, funnels, and forms we host for you display your content; you are responsible for having the rights to everything on them. We respond to copyright complaints: send notices identifying the material and its location to support@growdozer.com with subject "DMCA". We may remove content that infringes and may terminate repeat infringers.

11. Third-party services

The service is built on third-party providers (for example Stripe for payments, Cloudflare for infrastructure, Telnyx for telephony, Resend for email, and AI model providers). Their availability affects ours, and your use of payment features is also subject to Stripe's terms. We are not responsible for third-party outages beyond restoring service promptly.

12. Suspension and termination

You can cancel any time; your plan runs through the paid period. We may suspend or terminate for non-payment, for violation of these terms, or to comply with law or carrier requirements; where practical we will notify you and give you a chance to fix the problem. After termination you have the 7-day grace window to export data.

13. Disclaimers and liability

The service is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee delivery rates, search rankings, lead volume, or business results. To the maximum extent permitted by law, our total liability for all claims in any 12-month period is limited to the fees you paid us in the 3 months before the claim arose, and neither party is liable for indirect, incidental, special, or consequential damages. Nothing here limits liability that cannot be limited by law.

14. Indemnification

You will defend and indemnify TPS Worldwide LLC against claims arising from your content, your contact lists and messaging consent, your use of the service in violation of these terms, or your violation of law (including TCPA, CAN-SPAM, and consumer-protection claims arising from messages sent to your contacts).

15. Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Talk to us first: most issues are fixed fast through support@growdozer.com. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that venue.

16. Changes to these terms

We may update these terms as the product evolves. If a change is material we will notify you (by email or in the app) before it takes effect; continuing to use the service after that means you accept the updated terms.
